Probate Fees Calculator

Probate fees are based on the value of the assets located in British Columbia, at the time of death.  *The “value of the estate” means the gross value of (a) the real and tangible personal property of the deceased situated in British Columbia, and (b) if the deceased was ordinarily resident or “domiciled” in British Columbia immediately before the date of death, the intangible personal property of the deceased, wherever situated, that passes to the personal representative at the date of death.

Estimate the probate fee based on the gross value of your estate:

As of August 7, 2019, the Probate Fees in British Columbia are calculated as follows:

  1. If the value of an estate is less than $25,000, no probate fees are payable;
  2. If the value of the estate is more than $25,000, but less than $50,000, then the probate fee is $6 for every $1,000 (or part of $1,000) by which the value of the estate exceeds $25,000; and
  3. If the value of the estate is more than $50,000, then the probate fee is $14 for every $1,000 (or part of $1,000) by which the value of the estate exceeds $50,000.

There is a $200 court application fee for estates with a gross value of over $25,000.  In addition, often executors and administrators need court-certified copies of the grant of probate, or the statement of assets and liabilities, there is a cost $40 for each certified true copy.

BC Probate fees payable to the Minister of Finance are separate from legal fees paid to the lawyer to assist with obtaining the grant of probate from the court. Those fees vary depending on the complexity on the estate, please contact Open Door Law for more information.
